I honestly have no idea what to think of this. I can't find out anymore information about this.
I don't want to get into fearmongering. I want some information. Does this guy have things accurately, or is he (unintentionally) spreading overreactive information?

I don't think there's much bite to it, really. It'll become VERY hard to police and it just... doesn't seem like a hill you want to die on.

Someone in an AMV group I'm in posted something about this, too, and was all in a panic, including linking to an article that she obviously didn't actually read, because it spelled out just what this would apply to. And it's very, very narrow.
This law would only affect you if you had your own domain where you personally hosted more than 10 live streaming videos over a period of 180 days. This has no bearing on uploading a video of yourself playing a video game to YouTube, as you are not the content host.

Courts could readily determine that the extent to which such a "let's play" is recorded, namely a general full playthrough of the title, goes beyond standard fair use, even if for commentary purposes. Besides, it's not the punishment that tends to be the problem. It's the lawsuits. Those will be enough to screw shit up. Look at the Prince thread, specifically the bit about him bullying a photoshop competition, for an example.
