Since this isn't actually a "law" s the title says, but a policy voluntarily entered into by certain ISPs, there is no violation of the search and seizure clause.

Not to mention I'm sure it will be in the ISP's terms of service. I'm one of the four people who read Comcast's ToS. I'm pretty sure they reserve the right to hold down your first born and rape him/her while you are forced to watch and say encouraging things. (Note for the strangely literal crowd: I don't really mean they're baby rapers. Move along....) But they have all sorts of "acceptable use" clauses and the like in their ToS. Hell, they've probably updated it since I last checked it...2008.
