This case is real, though there's a bit more to it. www.theweeklyvice.com/2011/03/bei-bei-shuai-charged-with-murder-after.htmlAccording to this link, she did this in the last week of her pregnancy because her boyfriend broke up with her. And while this isn't a mainstream source, other more mainstream sources do confirm that the fetus survived at least two days outside the womb before dying. Make of that what you will.

Alright, so this here's how this is gonna work. She's going to get a counselor/psychiatrist to help her pro bono while she goes to the courts to have the charges dropped and countersues for pain and suffering because what a suicidal person needs is a federal "shuddup and stop yer bitchin'" used on them after failing to end their lives. I didn't read where this took place but.. way to go whoever tried this, I hope you learn what it feels like asshole.

Question: If the fetus had died in utero as opposed to after they removed it from her body, could she still have been charged with murder?

I'm going to be horrible person for saying this, but it's a dickish move on her part to attempt suicide when there's a baby depending on her to live. Mind you, if she was only early on in the pregnancy, I guess I could understand. But assuming she was later on in the pregnancy, (I didn't see it stated how far along she was), that seems such an idiotic and senseless thing to do.
But that being said, I don't think she should be charged with a crime, she needs treatment. To endanger the life of your future child usually means you're fucked up in the head somehow.

Actually, I have to agree with you here. This wasn't a clump of cells. This was a baby who survived two days outside the womb. She should definitely get help instead of being charged with a crime, but to me, she did kill her child.

Yeah, the fact that she was so far along and the baby survived for several days outside the womb (assuming the article is accurate) complicates things for me. Honestly, I'm facing a bit of a moral dilemma on this one.

Okay, so... crime or not, she still needs psychiatric help. The only difference is where it takes place.

Send her to a psychiatric institute, not a jail.
We have a mental 'jail' here in Augusta, in fact.

^^ Because prison is just the sort of caring environment to restore your faith in humanity and convince you that life is worth living when you're feeling fragile!
Whose stupid fuckin' idea was this?
