And when they do, the people's elected representatives will change them. If they aren't acting fast enough, then the people need to put more pressure on them, or elect new representatives.
It depends on what the minority is. Not all minorities have the same circumstances.
Every law that is passed, and every amendment to the Constitution that is ratified, is done so entirely by people we choose. To quote Rousseau, in a Republic when you obey the law, you obey yourself. The notion of the "social contract" starting with Hobbes, is seen as the founding principle of the modern-day state. The governed consent and submit themselves to a governing document that is the basis of their civil society. Locke expounded more on this, stating that the People vest most of their sovereignty in this civil state, but retain some soveriegnty for themselves (known as "negative rights"). It was Thomas Jefferson who said that "The whole body of the nation is the sovereign legislative, judiciary, and executive power for itself. The inconven-ience of meeting to exercise these powers in person, and their inaptitude to exercise them, induce them to appoint spe-cial organs to declare their legislative will, to judge and to execute it” (“Letter to Edmund Randolph,” 18 August 1799)
"Direct rule of the majority" does not necessarily mean the "will of the People" if the People do not wish to have direct rule by majority in certain areas.
So in short, if there is no constitutional right to eat horse meat, I firmly believe that the people have the right to ban or allow this practice as they wish via their democratically elected representatives.
