so far it sounds as if we're beating the shit out the yes on 8 folks.. Judge Ware sounds awesome.

A thought: I'm mildly tempted if I were there to stand up and put an end to Cooper's rambling. Just say like "okay I think he means this! I'm sorry Judge.. I support the pro-LGBT side but.. he was gonna go on forever... it was getting kind of embarassing to watch even for my side. I was embarassed FOR him that he couldn't string together a cogent argument to save his damn life."

Wiat, does this mean that the Pro-LGBT side is winning despite its lawyer being unable to string together a coherent argument? Just how bad is the oppositions argument then?

Nooo, I meant that Cooper (the Yes on 8 anti-gay side) can't string together a coherent argument. We're running circles around them. I was joking that their argument was so bad that even though, as a gay man, helping them would hurt me infinitely and I'd rather see them lose, it'd be funny to stand up and make their argument (Cooper used a lot of circular b.s reasoning) for them.. basically saying "Yeah.. he doesn't want Walker to rule because Walker's gay, he says that's not the reason but.. it is.. I'm sorry but he was gonna keep repeating himself and going in circles forever if someone didn't just come out and say it - this is going to be the case that makes marriage equality legal across the USA, I want our enemy to actually be able to string together a sentence, otherwise it's no fun winning"

Judge: Do you have any proof Walker planned to get married?

Cooper: No, but he's gay.

Judge: Do you think a black judge should be forced to recuse himself in a civil rights case?

Cooper: No, but Walker is gay.

Judge: Could a gay judge rule on DADT?

Cooper: Yes, but not on marriage.

Judge: Should a female judge who's been raped in the past be forced to disclose such information and recuse herself from a case involving rape?

Cooper: Well... uh... but Walker's gay!

I loved that question from the judge. It really put the anti-gay people on their heels and let everyone else see what their real argument is.

SAN FRANCISCO – A federal judge on Tuesday upheld a gay judge's ruling to strike down California's same-sex marriage ban. Chief U.S. District Judge James Ware said former Chief Judge Vaughn Walker did not have to divulge whether he wanted to marry his own gay partner before he declared last year that voter-approved Proposition 8 was unconstitutional.

Lawyers for backers of the ban argued at a hearing Monday that Walker should have recused himself or disclosed his relationship because he and his partner stood to personally benefit from the verdict.

Walker publicly revealed after he retired in February that he is in a 10-year relationship with a man. Rumors that he was gay had circulated before and after he presided over the trial in early 2010.

Ware said the ruling by Walker, who did not attend Monday's hearing, raised important questions and called it the first case in which a judge's same-sex relationship had led to calls for disqualification.

He said there probably were similar struggles when race and gender were the issues.

Many legal scholars did not expect Ware to overturn Walker's decision. They said having a judge's impartiality questioned because he is gay is new territory, but efforts to get female judges thrown off gender discrimination cases or Hispanic judges removed from immigration cases have failed.

Theodore Boutrous Jr., part of the legal team representing the two gay couples who filed the lawsuit against Proposition 8, called Cooper's arguments frivolous, offensive and unfortunate. He said Walker was being targeted because he is gay.
