An update that might change the way this is being seen.The city and county have not stopped prosecuting just domestic violence. They have stopped prosecuting all misdemeanors, half of which are DV. Possession of marijuana is also a misdemeanor. So they are NOT prosecuting possession and letting abusers go free. Both are walking.

Here's the real question. Why the hell is domestic violence only a misdemeanor? *humorless smile* I agree. You can imagine my reaction when I found out DUI (when there isn't injury or death) is a misdemeanor. That's bugging me too. So what's assualt? Misdemeamor. Agg assault (defined as deadly weapon or when there is intent to commit a felony) is a felony. But I think you meant to ask about battery. Assault is just making threats of bodily harm to another person when the other person has reason to believe you will carry through. Battery is when you actually touch another person and cause harm. Battery is also a misdemeanor. |

It's hard to imagine better news for the citizens and communities in Kansas. If this trend actually holds, I would seriously consider moving there.
